Acceptance of Terms
Please read the following carefully! Your access to and use of this Site and your participation in our services is subject to these legally binding terms and conditions, which you accept and agree to by accessing this Site, our social media accounts, or by signing up for or participating in our services. The following terms and conditions (“Terms and Conditions”) form a binding agreement (“Agreement”) between you and True Align Pilates LLC. (“True Align Pilates”). If you do not agree with these Terms, please do not use the Site, our social media accounts, or any services offered.
Use of the Site
Any information on this Site, including videos, images, written content, and virtual or at-home resources, is provided for general informational purposes only and should not be relied upon as individualized instruction or professional guidance. By using this Site, booking a session, or participating in any services you agree to these terms and accept that following and using any information or recommendation provided on this Site is at your own risk.
Services
True Align Pilates offers instruction through private, duet, small group, in-studio, in-home, virtual sessions, and special offerings and events (the “Services”). Sessions are led by an apprentice or instructor-in-training who is completing required coursework, observation, teaching hours and assessments as part of a certification program. The Services may also be led by certified instructors. By booking or participating in sessions, you acknowledge and accept the instructional level of the practitioner. Class sizes may be limited.
Booking, Registration, and Participation Requirements
Eligibility and Participation. You represent that you are at least 18 years old and have the legal capacity to enter into these Terms.
Accurate Information. You agree to provide accurate, current, and complete information when purchasing or registering for the Services, including health information, and to update it as needed, or as requested by us. Failure to update us on changes in your health information may disqualify you from participating in the Services.
Right to Refuse or Remove. We reserve the right, to the extent permitted by law, to refuse, suspend, or remove participation in any Service for material rule violations (including violation of these Terms), disruptive behavior, unsafe conduct (i.e., to yourself or others), or failure to meet disclosed participation requirements. We will not exercise this right in a manner that unlawfully discriminates against any participant. If you are removed from our Services for violating these Terms, no refund will be provided. If we cancel you from a Service (absent your violation of these Terms), we will issue you a full refund for any unused portion of any Services which you have paid for in advance, less any payment processing fees.
Group Conduct
Respectful Participation. You agree to participate respectfully and not to disrupt the Services, harass others, or engage in unsafe, threatening, discriminatory, or abusive behavior. Harassment of any kind will not be tolerated.
Privacy of Others. In group settings, you agree to respect the privacy of other participants and not to disclose personal information shared by others, except as required by law.
Personal Property. You are solely responsible for your personal belongings at all times, including during in-person sessions (personal or group) and events.
Disclaimers
Our goal is to share information in an informative, open, and honest way. Any information and services provided on or through the Site are for informational and educational purposes only. What we share is the opinion and perspective of True Align Pilates, and not any owners, employees, contractors or affiliates. The information and education are not intended or implied to supplement or replace medical or physical therapy advice. Before taking any action, please make sure you consult with a qualified medical professional or licensed physical therapist.
No Guarantees
We make no guarantees about any particular results or benefits that you’ll get from our Site, our products or our Services. We will empower you with the tools to help you succeed, but we make no guarantees. We cannot be clearer about this: we make no promises regarding results and make no guarantees whatsoever. True Align Pilates and its owner, directors, agents, employees and affiliates assume no responsibility or liability for any consequence resulting directly or indirectly from any action or inaction you take based on the information found on the Site or material linked to this Site, or our Services.
Intellectual Property
All content on this website, including text, images, graphics, logos, videos, and other materials, is the property of True Align Pilates or is used under license and is protected by copyright and other intellectual property laws. Some images and visual content may be licensed from third-party providers and are used in accordance with their respective licensing agreements.
No Recordings. You may not record our Services without our prior written consent. For copyright purposes, we are deemed to be the first to record any live streaming event that we host.
Photo Release and Permission. By participating in our Services or any online or in-person event, you consent to our use of photographs, video recordings, and other media capturing my image or likeness during the Services for promotional, marketing, and advertising purposes, including but not limited to print materials, digital platforms, social media, websites, and other electronic or physical media. I also understand that no compensation will be provided for such use. I further understand that I may opt out of this consent by providing written notice to the Provider at move@truealignpilates.com prior to the Service. The opt-out must clearly state my intention to withhold consent for photo and media use. If no opt-out is received, the Provider may use such media as described above. If the opt-out cannot reasonably be accommodated for a particular Service, I understand that I will be so informed and given the opportunity to withdraw from the Service.
Website Use
Permitted Use. You may only use our website for lawful purposes and in accordance with these Terms.
Prohibited Conduct. You agree not to interfere with the website’s operation or security, attempt unauthorized access, scrape content at scale, transmit malware, or misuse forms or communications channels.
Intellectual Property. Unless otherwise stated, website content and materials provided through the Services are owned by the Company or its licensors and may not be copied, distributed, or used beyond personal, non-commercial use without prior written permission. You may not copy this Agreement or any of our agreements, such as our Liability Release and Wavier Agreement, Privacy Policy, disclaimers, or content of any kind and use them as your own.
Website Accuracy. We try to keep information accurate and up to date; however, we do not warrant that descriptions, pricing, or availability are error-free. We reserve the right to correct errors and, if applicable, offer you the option to proceed at the corrected price or cancel for a refund of amounts paid for the affected purchase, which you agree shall be your sole remedy.

This Site may contain links to third-party websites. All such linked sites, materials and pages are not under the control of True Align Pilates and True Align Pilates is not responsible for the content contained in any linked website nor for any losses or damages you may incur as a result of the use of any third-party website. True Align Pilates accepts no liability for any errors or omissions contained in third-party websites. These links are provided to improve your use of this Site, enable you to connect with True Align Pilates on various platforms, and to help True Align Pilates offer the Services to you and for you to conduct transactions.
Payments, Fees, and Billing
Payment required in advance. Payment in full is due and payable in advance of all Services, unless otherwise specified at check-out. If you purchase a package or program, you must remain current on all required payments to schedule or attend sessions.
Payment methods and processors. Payments may be processed through third-party payment processors. Your use of a payment processor is subject to that provider’s terms and privacy practices, which are out of our control. We are not responsible for errors or service interruptions of third-party processors, and such processors may assess a service or convenience fee in addition to our charges. You may contact us directly at move@truealignpilates.com to inquire about alternate payment methods in lieu of making payment through third-party providers (such as payment by physical check or wire transfer), which we may choose to accept or reject in our sole discretion. We may also accept, from time to time, other payment methods such as Venmo, Zell, or other payment providers.
Unauthorized or improper chargebacks; cancelled checks; fees. If you initiate a chargeback or payment dispute in violation of these Terms or the applicable cancellation/refund policy, or if any check is returned or payment is reversed for insufficient funds or similar reasons, you authorize us to assess a $30 cancelled check and a $50 chargeback administrative fee (in addition to any amounts otherwise owed). You further agree to reimburse us for reasonable costs we incur in responding to or disputing an improper chargeback, including reasonable attorneys’ fees.
Validity Period of Purchase Services. Unless otherwise stated, our Services must be used within 6 months of purchase.
Taxes. You are responsible for any sales, use, value-added, or similar taxes that may apply to your purchase, except to the extent we are required by law to collect such taxes.
Cancellation, Rescheduling, and Refund Policy
Payment in Advance; No refunds. Unless otherwise stated in the applicable terms at the time of payment (checkout) refunds are not allowed and payment in full is required for the full price of the Service purchased. Eligibility for any refund or credit, such as based on a re-scheduling request, will be determined under these Terms and any applicable checkout terms. We may, from time to time, offer payment plans, and such terms will be specified at the time of payment.
Arrival Time. Please arrive on time for your class or session. For safety and out of consideration for others, late arrivals more than 15 minutes after the start time may not be permitted to join, and the class will be considered used. Private sessions may be shortened to respect the schedule of other clients.
24-hour Cancellation Rule. For all of our Services (including privates and group sessions within a package or program), you must cancel or reschedule at least twenty-four (24) hours in advance of the scheduled start time. If you fail to cancel or re-schedule at least 24 hours in advance (including no-shows), you will be charged in full for the session. All rescheduling requests must be submitted in writing to move@truealignpilates.com or texted to 347-227-1623. We are not required to provide you with a refund for any reason.
Cancellations by True Align Pilates. If we are forced to cancel a session, then you will not be charged and we will work with you to re-schedule your session at a mutually agreeable time. We reserve the right to cancel a Service at any time, with or without notice; no refunds will be provided.
Courtesy exceptions. From time to time, we may, in our sole discretion, offer a credit or accommodation that is otherwise not required by these Terms. Any such accommodation is a one-time courtesy, is not guaranteed, and does not waive our right to enforce these Terms in the future.
Promotions, Special Offers & Events
From time to time, True Align Pilates may offer promotions, discounts, private events, group bookings, or special programs that are subject to separate, offer-specific or event-specific terms and conditions. Such terms will be provided at the time of booking or purchase and may include different payment, cancellation, and refund policies. In the event of a conflict, the offer-specific or event-specific terms shall govern.
Limitation of Liability and Indemnification
Limitation of Liability. In no event shall True Align Pilates or its owner, employees, contractors or affiliates be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption, or any consequential damages), direct or indirect, arising out of the use or inability to view or use the materials or content on the Site or ability to access the Services, even if True Align Pilates has been notified orally or in writing of the possibility of such damage.
Indemnity. As a condition of your use of this Site and the Services, you indemnify True Align Pilates and its owners, directors and affiliates from and against any and all liabilities, expenses (including attorney fees and costs) and damages arising out of claims resulting or arising from your use of this Site and the Services.
Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
Choice of Laws and Venue
The parties agree to irrevocably submit all claims relating to these Terms and Conditions to the exclusive jurisdiction of the courts of the State of New York without regard to its conflict of law provisions, with venue for any disputes in the state and federal courts located in or closest to Brooklyn, New York.
Dispute Resolution; Time Limit; Class Action Waiver
Good-faith resolution. The Parties will attempt in good faith to directly resolve any dispute arising out of or relating to this Agreement through informal discussions for a period of at least 30 days (with or without the assistance of counsel), which shall include at least one in-person or telephone consultation with all parties participating.
Shortened Limitations Period.
ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICES MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER THE CLAIM OR CAUSE OF ACTION ACCRUES, REGARDLESS OF ANY STATUTE OF LIMITATIONS TO THE CONTRARY.
The parties agree that this shortened limitations period is reasonable in light of the nature of the Services and the need for prompt resolution of any disputes. Failure to bring such an action within the applicable time period shall be a complete bar to any such action and a full and complete waiver of any rights or claims based thereon. This time limitation period may be shorter than that provided by general or categorical (e.g. tort, contract, etc.) law of the State of New York.
Class Action Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR OTHER REPRESENTATIVE PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES. YOU AGREE TO WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS‑WIDE ARBITRATION.
No Assignment
You may not assign your rights or obligations under these Terms without our prior written consent.
Force Majeure
The Company shall not be liable for any failure or delay in performing its obligations under this Agreement, if any, if such failure or delay is directly caused by specific events outside the Company’s reasonable control and not due to its own fault or negligence, including natural disasters, acts of war, terrorism, government orders, strikes, pandemic, or widespread disruptions to internet or communications services. In such an event, the Company will promptly notify you of the event and make reasonable efforts to resume performance as soon as possible. If performance cannot be resumed within thirty (30) days, either party may terminate this Agreement without penalty by providing written notice to the other party.
Entire Agreement
These Terms and Conditions, together with our Privacy Policy, Social Media Disclaimer, Release and Waiver Agreement, and any other legal notices, policies and guidelines of True Align Pilates linked to these Terms and Conditions or posted on this Site, constitute the entire agreement between you and True Align Pilates regarding your use of this Site and the Services, and supersede all prior or contemporaneous understandings, agreements, claims, representations, and understandings, whether oral or written, relating to the same subject matter. This Agreement may not be amended or modified except by True Align Pilates. Paragraph headings are for reference only.
Modifications of these Terms
True Align Pilates may modify, amend, supplement and replace these Terms and Conditions at any time without providing you with advance notice. Your continued use of this Site after any change means you have accepted the changed Terms and Conditions.
Severability
If for any reason a court of competent jurisdiction finds any provision or portion of these Terms and Conditions to be unenforceable, that portion or provision shall be enforced to the maximum extent permissible so as to effectuate the intent of the parties as reflected by that provision, and the remainder of these Terms and Conditions shall continue in full force and effect.
No Waiver
Failure by True Align Pilates to enforce or exercise any provision of these Terms and Conditions shall not constitute a waiver of that right.
